Arista Records, Inc. v. MP3Board, Inc., 2002 U.S. Dist. LEXIS 16165 (S.D.N.Y. 2002)
The court found that two cease and desist letters sent by Arista to the ISP of a Web site accused of containing links to unauthorized copies of music recordings were insufficient forms of notice under the DMCA because the letters contained only the names of recording artists whose recordings were being infringed. The court concluded that adequate notification required at least the names of the copyrighted recordings allegedly being infringed.
